Terms of service
The deal, in plain language.

1. Who you are contracting with
The service is provided by KlarPass, Spoorlaan 18B, 2495 AL Den Haag, Netherlands, registered with the Dutch Chamber of Commerce under KvK number 93137044. In these terms “we” and “us” mean KlarPass, and “you” means the organisation holding the account.
2. What the service does
KlarPass lets you record product and packaging information, check it against structural rules, publish it as a hosted public page with a QR code, and keep a version history of what was published. The service is intended for businesses. It is not available to consumers.
3. Compliance tooling, not legal advice
We help you structure and publish information required by EU product and packaging rules. We do not give legal advice and we do not certify compliance. Our checks verify the format and internal consistency of what you enter — that a GTIN has a valid check digit, that percentages fall in range, that required fields are present. They cannot verify that your data is true.
You remain responsible for the accuracy and completeness of everything you publish, and for determining which obligations apply to your products. Regulations change and our templates are updated as they do, but the responsibility for compliance stays with you.
4. Accounts
You need a verified email address to use the service. Keep your credentials confidential; you are responsible for what happens under your account. Tell us promptly if you believe it has been compromised. You may invite colleagues to your organisation and are responsible for their use of the service.
5. Plans, payment and VAT
Plans are priced by the number of passports you publish. Scans of a published passport and printed copies of its QR code are unlimited. Prices shown exclude VAT, which is added at the rate applicable to your billing country.
The trial is a one-off payment and includes one published passport. Starter and Growth are monthly subscriptions that renew until cancelled. Payments are processed by Stripe; we never receive or store your card details. You can cancel at any time from the billing page, effective at the end of the paid period. Payments already made are not refunded pro rata, though we will always look at genuine mistakes sensibly.
If you exceed your plan's limit, publishing further passports pauses until you upgrade. We never take existing passports offline for this reason.
6. Published passports stay online
A QR code printed on packaging has to keep working for the life of the product, so we treat availability as an obligation rather than a feature. Passports you have published remain publicly accessible if you downgrade, cancel or stop paying, and you can continue to correct their content so a live passport is never stranded with data you cannot update.
We aim for continuous availability but do not offer a formal uptime guarantee except where agreed separately on the Scale plan. Maintenance, provider outages and factors outside our control can cause interruptions.
If we ever discontinue the service, we will give you at least six months' notice and work with you to keep published passport addresses resolving.
7. Your data
The product data you enter is yours. We process it to provide the service and do not sell it or use it to advertise to you. You can export everything, including version history, at any time from your dashboard. Application and data are hosted in the European Union.
Passport information you mark as public is, by design, published to anyone who scans the code. Information marked restricted is not shown publicly. How we handle personal data is described in our privacy statement.
8. Acceptable use
Do not publish unlawful content, impersonate another company, or use the service to mislead consumers or authorities. Do not attempt to break, overload or gain unauthorised access to the service. We may suspend an account that does these things; where we do, published passports stay online unless the law requires otherwise.
9. Liability
We provide the service with reasonable skill and care. To the extent permitted by law, our total liability in connection with the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits or the cost of reprinting packaging, or for penalties imposed on you by an authority.
Nothing in these terms excludes liability that cannot be excluded under Dutch law, including liability for intent or deliberate recklessness.
10. Changes
We may update these terms as the service develops. If a change materially affects you we will give reasonable notice by email before it takes effect. Continuing to use the service after that means you accept the new terms.
11. Law and disputes
Dutch law applies. Disputes go to the competent court in The Hague, unless mandatory law says otherwise. We would much rather hear from you first at deepinsightdata+klarpass@gmail.com.
